Can I now make use of Labour approved in 2010?

Hello

 

When I was in my 1st H1B, I got my Labor approval in 2010 with employer 1. After that due to personal reasons I had to leave to India. I came back to US in 2013 in my 2nd H1, filed by employer 2. Now I am planning to apply GC through employer 2. Is there any chance I can make use of my labor approval? 2nd H1 is newly filed and was not under cap exempt.

No. That LC is gone

PERM validity is 180 days before an I140 has to be filed. Also, a PERM from one employer cannot used by another.
