Hi All...

Of-course this question is discussed many times in this forum.. But need some clarification.

Total H1b Period validilty = 6 Years = 6 x 365 = 2190 days.. Hope this is correct if i am wrong.. ( i.e, total stay period in USA ).

I came to USA through Employer A in Sep 12, 2011 and my stay period is

12 Sep 2011 - 15 Nov 2012 = 430 days. then i went to india came back in

17 Jan 2013 - 05 May 2013 = 108 days. then i went to india came back in

13 Jun 2013 and never traveled back to INDIA.

I changed to Employer B and got H1b approval with I-94 until 05 May 2018.

Total number of days from 13 Jun 2013 - 05 May 2018 = 1718 days.

Total period in USA = 430 + 108 + 1718 = 2256 days.

i think i got 66 days more than 6 Years ( 2190 days).

Correct me if i am wrong in calculating...
Do my H1b Approval with i-94 need to be corrected?
Any issues sticking to correct H1b approval?

Vamsi

Thanks Jairichi for your reply...

My question is right now i got H1b approval with i-94 until 05/05/2018... i calculated days stayed till now + days left over until 05/05/2018 = 2256 days..

Based on 6 year rule : 365 x 6 = 2190 days.

I got 66 days extra in new i 797 with i94...

My Question is whether it need to be corrected or can i use until the i94 validity?

Appreciate your response....

Regards,

Vamsi.

No need for any correction. By the time you reach 6 years move to a dependent status or exit US.
