Saranyachoudary Posted October 19, 2015 Report Share Posted October 19, 2015 I am currently on J1 research scholar visa which will expire November 30 2015. I have a J1 waiver. I would like to change to H4 and susequently to EAD as my husband has his i140. I would like to know which is the quickest way to get H4/EAD. would it be quicker if I go to india and get a H4 and come back to usa and apply for EAD or can I stay in USA and apply for the both. I was told EAD takes 3 months after obtaining H4. How long does H4 take if I apply from USA? Also can I work on the current J1 after applying for H4/EAD? Thank you Link to comment
jairichi Posted October 20, 2015 Report Share Posted October 20, 2015 Better is to go for visa stamping. It is taking more than 4 months to get COS to H4. You can work on J1 till your DS2019/I94 validity date or COS to H4 approval date whichever is earlier. Link to comment
