How to apply for H4 visa when spouse of F2 changes from F1 to H1B?

Hi all,

 

I am currently staying in US on F2 visa. My husband applied for H1B and it got picked in the lottery. It got an RFE and the response is submitted. Now waiting for the final response. If the H1B is getting approved, will there be a gap between the approval date and H1B visa validity start date? If no, how can I apply for the H4 dependent visa? Is there a way that I can apply from US itself?

Once your spouse's H1B petition is approved apply for a COS to H4 using for I539, supporting documents and fee.
