PERM Application

Hi All,

 

BACKGROUND:

 

Previously I was with Employer XYZ. Now I am with Employer ABC. With Employer XYZ, my I-140 is approved but with Employer ABC PERM got denied. Appeal has been made on the decision by Employer ABC but that one also got rejected.

 

QUESTION:

 

1. Filing new and fresh PERM again with Employer ABC will work ??

2. My Previous Employer XYZ has filed my GC in EB3. If I decide to go back to him, will he be able to file / port my GC from EB3 to EB2 ? Is there any such provision available ?

1.Yes

2. only if there is a new job under EB2 category. It will be the same process again.
