An employee X (in bench/free pool) has submitted his/her resignation with 2 weeks notice period. In case company A does not relieve him/her with in 2 weeks notice period, can he/she join company B after 2 weeks of notice that he/she had submitted? Assuming his H1-B visa has been transferred to Company B. Will there be any problem for processing GC if he/she gets affidavit on experience he/she had spent in Company A from his colleagues and Supervisor? How many such affidavits should one get? JoeF Posted October 7, 2015 Report Share Posted October 7, 2015 Is the employee paid? A person on H1 always has to get paid, even on bench. That's the law. I would expect a company to be happy to let the person go to another employer instead of continuing to pay the person. Link to comment
