cgate Posted October 5, 2015 Report Share Posted October 5, 2015 Hello, I had applied for H1b visa extension and last week I have received an RFE for the same. USCIS has asked for the approved 1-140 ( My 6th year would in H1b would complete in the next week) My PERM is in the process as of now ( It was applied in April ,15). In this scenario,what would be the best way to reply the RFE. I was out of the country for almost 3 months. Could I accumulate the time when I was outside USA and request for an extension for 2-3 months. I think if I get extension for 3 months , by the time my PERM would be approved and I would be apply for another extension at that time. Kindly please suggest me. Thank you Link to comment
jairichi Posted October 5, 2015 Report Share Posted October 5, 2015 You can get those 3 months. But, in your case an approved PERM is of no use. You need to have approved I140 to get extensions. Link to comment
