Returning from India one month before OPT expires and OPT extension status is pending.

Hi,
 

My OPT expires on 9th Feb 2016 and I will be applying for the extension on 12th October 2015. I am travelling to India on Dec 10th and will be returning only on Jan 10th. Is it safe make this trip? If the new OPT STEM law is approved , there will no OPT extension from Feb 12th 2016. Will that effect me?
