vijay_123
I have an approved I-140 and returned to India 3 years back (2012) after my I-485 applied . I was on EAD and AP during that time. My I-140 never revoked. I have completed H1B 6 year term and got extensions based on GC pending when was in US. The question is, based on my I-140 approval, should I eligible for H1B outside the lottery system, if some company willing to sponsor H1B and then GC process later. Can some experts please comment? Can any company can sponsor H1B outside the quota using I-140 approval? Thanks, Vijay Link to comment
vijay_123
Thanks jairichi. That means if we have an I-140 approved and outside US for few years, still can use it for getting H1B outside the quota. GC process (starting with Perm) the employer has to start once again and can use old I-140 priority date once I reach US using H1B. Is my understanding correct? Link to comment
