H1B Transfer in process (Delayed), i-94 expired, any chances of H1B Transfer

Hi,

 

My current H1B petition transfer from Employer A  to new Employer B is pending/delayed and my I-94 is expiring. My original  petition by Employer A was revoked.

 

I am currently working with Employer-B with the receipt - received on 05/04/2015. But regular process still pending. Could you please advise what are the options available incase if get a RFE or Denial for Employer B petition.

 

can I have another employer C to start new petition while current one in pending by Employer B after I-94 expire date ? please advise me.

Yes, employer C's petition will be considered as bridge petition.

If C files after I94 expiry date and B's petition is denied you will need to exit & enter US with valid H1B visa & C's I797 to work for C.

Would like to update on this. My pending case was approved after upgrading it to Premium. My case was received on 05/04 for regular process and was pending for more than  4 months. On 09/22 upgraded to premium and got the approval on 09/04.
