krishna.v524 Posted September 18, 2015 Report Posted September 18, 2015 Hi , I have a valid H1B till August 2016. But my I94 is valid only till November 2015 because of my passport validity. I extended my passport now and my employer filed for H1B extenstion in July. I am still waiting for the extension to be approved. I have a travel plan to India in December 2015 . My question is even if I dont get the extension appoval by then, Can I travel to India and come back to US as I have a valid Visa till August 2016 ? Also what if my extension approval comes when I am in India during December 2015, should I go for a stamping or will I be still able to come to US with my old Visa which is valid till 2016?
jairichi Posted September 18, 2015 Report Posted September 18, 2015 You can travel back with a valid H1B visa and I797. Even if H1B extension is approved there is no need for visa stamping.
