divya99 Posted September 15, 2015 Report Share Posted September 15, 2015 Hi, Please need very urgent advice on this...I had my first H1b from Oct 2006 to 30th Sept 2009 after my OPT..I moved out of US in March 2009. I would like to know if I am cap exempt if a company files my H1b now..Please also tell me how this cap exempt works...How long I am cap exempt ?? Anyone who has already gone through H1b cap exempt will be really helpful... Its very urgent as I would be paying for H1b cost and would like to know I will get through or it will be rejected...I know it depends on application but I am asking from USCIS rule point of view.. jairichi Posted September 16, 2015 Report Share Posted September 16, 2015 First paying for H1B filing is illegal. Stay away from employers who ask for H1B fee. Yes, you are cap exempt. An employer has to file a cap exempt H1B petition & on approval you can work. You are cap exempt till you reach the maximum allowed stay of 6 years on H1B. Link to comment
