bitturadha Posted September 15, 2015 Report Posted September 15, 2015 Please help on my situation. My 6th year of H1B is completing in Jan 2016. My PERM was filed in SEP 2013 and is currently in reconsideration (probably moving to BALCA). My company has applied for my 7th year of extension. 1) Can I switch company if my new employer is ready to file new PERM? 2) Can I switch to F-1 status and move to a college and after completion of my course, can I get a new H1? Does it carry other risks? 3) Can 2 PERMS be applied in parallel if my current company agrees to file a new PERM? 4) What other options do I have? thanks !
jairichi Posted September 15, 2015 Report Posted September 15, 2015 1. Yes. 2. No. To get new 6 years H1B you need to stay outside US for one year after which a cap subject H1B petition has to be filed. 3. Yes.
jairichi Posted September 15, 2015 Report Posted September 15, 2015 thank you ! You need to know that only if your PERM is pending you are eligible for 1 year extension with new employer.
