H1B transfer while Amendment In process

Hi,

My extension and amendment petition is filed and is currently in process (status is Case is Received). During this time, Can I initiate my H1 transfer to an other Employer with the new location.

Kindly let me know the possibility.

I am facing a similar issue. My H1B extension with company A is in RFE and Visa is expiring on 30th September 2015. Can I go ahead to transfer the Visa to company B before the expiry? If it is possible, till when I can proceed transfer?

Yes. If employer B initiates H1B transfer after your I94 expiry then it will be considered as bridge petition. In that case if employer A's extension is denied then employer B's I797 will not have an I94.

 

If employer B's H1B transfer is filed before your I94 expiry then outcome of employer A's extension petition will not affect B's.
