kumarmk Posted September 9, 2015 Report Share Posted September 9, 2015 Hello My 6 year term is ending in Jan 2016 and labor was filed in June, just about 7 months before finishing my 6th year. My wife is on H4. I am just thinking of my options in case labor doesn't get approved to continue work or take a break. should I go back to india or either one of me or my wife join a college and change the status? regs Kumar Link to comment

gsaneja Posted September 25, 2015 Report Share Posted September 25, 2015 when your perm approval comes hopefully in Dec/early Jan, your employer can file your i-140 under premium processing and after 2 weeks your employer can apply for 3 years h1b extension; in this scenario you may have to take couple of weeks vacation and come back with new h1b Link to comment
