rickyroy Posted August 19, 2011 Report Share Posted August 19, 2011 I had visa transfer to company A from my previous employer and extended till 2014 and never travelled after the extension. I had visa stamped from my previous employer which will expire on Nov 9, 2011. I am trying to explore options to reduce the chances of visa stamp rejection. Note : In fact i heard there are no chances of visa rejection as long as i have direct client documentation in place. Is it true ? That being said, if i can travel to India and return before Nov 9, 2011 , do i still need to go for visa stamping. Is it acceptable at port of entry with old stamping on my visa also shows old petitioner name on the passport before Nov 9, 2011. Link to comment

A person can re-enter the U.S. with still a valid H-1B visa stamp (for Company A) and a new I-797 H-1B approval notice (for Company B). The CBP officer at the Port of Entry should issue the I-94 card valid until the expiration date of the I-797 H-1B approval notice for Company B rather than the expiration date of the H-1B visa stamp for Company A. Please note that it is always possible that an H-1B visa application can be delayed or denied at a U.S. Consulate abroad. Link to comment

Just want to get better understanding on the below statement mentioned by you. Does this mean , there is a possibility of visa stamping rejection at US consulate in India ? ...so it is better to use old stamping rather than give a try later to go for another stamping?
