nandac Posted September 4, 2015 Report Posted September 4, 2015 with a GC, do we stay atleast 6 months in the USA every year? and with EAD, we only need to be in the USA at the time of application and receipt - based on how much duration the EAD has been granted and the renewal? so we can have an EAD and still be outside the USA? appreciate the insights.
JoeF Posted September 4, 2015 Report Posted September 4, 2015 With a GC, you have to LIVE in the US. It is called Permanent Residence for a reason. You can of course visit abroad, but your home has to be in the US.
nandac Posted September 5, 2015 Author Report Posted September 5, 2015 Thanks for the input on GC. Likewise can I have some insights on EAD? With EAD, do we need to be in the USA only at the time of application and receipt - based on how much duration the EAD has been granted and the renewal. So if I apply for EAD, I need to be present in the USA at the time of application. And if I am granted 3 years EAD, then I need to come to the USA only after 3 years for renewal? Appreciate the feedback.
JoeF Posted September 6, 2015 Report Posted September 6, 2015 The EAD is a work permit. It has nothing to do with how long you can stay abroad. For that, you need AP.
nandac Posted September 7, 2015 Author Report Posted September 7, 2015 My question regarding EAD is not about how long I can stay abroad. But rather how long I should be in the USA every year, if I have an EAD? Appreciate the feedback.
JoeF Posted September 8, 2015 Report Posted September 8, 2015 My question regarding EAD is not about how long I can stay abroad. But rather how long I should be in the USA every year, if I have an EAD? Appreciate the feedback. Your question doesn't make sense. The EAD is a work permit. It allows you to work in the US. Nothing more, nothing less. It has absolutely nothing, zero, nada to do with how long you can stay in the US or not.
JoeF Posted September 8, 2015 Report Posted September 8, 2015 To make it clear again: How long you can or have to stay in the US is not governed by the EAD. It is governed by other things.
