Will H4 processing void current H1B

Hi,

My Wife have valid H1B and still working with same employer in INDIA. She is waiting for opportunity to travel. But I would like to get her with me by apply H4.

 

1. If I do so, weather her H1B get void?

 

2. If H4 approved and H1 got void, then I have to apply fresh H1 for her or just COS?

 

 

Please help me.

1. She is cap exempt.

2. COS as cap exempt H1B petition.

You don't apply for an H1, her employer would have to.

And a COS is just a new H1 petition.
