Sin2601
Hello, I would like to have expert comments/analysis on my situation. Kindly help. I studied in USA (Master's), have been working for single/same client since my graduation (2 years 3 months in EVC model). I am currently on OPT STEM EAD valid until November 2015. My H1B for FY2016 is approved for 3 years. I have a H1B Visa stamping interview scheduled at Ottawa, Canada on September 18th, 2015, and I intend to travel back to US sometime from September 24th-September 27th. (The reason for wanting to get my H1B stamping is because I have a family trip coming up in November 2015 in Canada, and I don't have time to travel to India which is my home country for getting my H1B visa stamped, the reason for choosing September is my project has less workload during this time frame and my manager granted me permission to work remotely from mid to end September). My question is: Is this a practical scenario? I want to re-enter USA with H1B status and NOT on OPT STEM status in September last week. I post this question here for expert comments as my friends and peers were suggesting some speculations around the status of my entry to USA if I re-enter during September last week compared to status I re-enter USA after October 1st. P.S: I have all the documents needed for attending the H1B interview in confidence. Thanks Murthy Law firm. Best Regards, Sin2601 Link to comment
jairichi
You are fine to enter US with a valid H1B visa and I797 during the last week of September 2015. Link to comment
