H4 (I-539) Petition I-94 expired, Attorney did not file extension yet, What to do?

My 6 year old daughter is here with me in USA on H4, as per her I-539, her I-94 was valid till 08/20/2015. My H1 petition was valid till 08/20/2015. Attorney filed extension for my H1 in regular processing and I have received receipt number and its currently pending, whereas somehow my attorney forgot to file extension for my daughter's I-539. What are the options I have now? Please help and guide. Thanks !
