kbm10 Posted August 23, 2015 Report Share Posted August 23, 2015 Currently I am working for large organization and about to reach 5th year of H1B. My employer is interested in filing my green card. Attorneys are advising to hold off filing of PERM for few months due to recent layoffs in another group in same location. My manager is supportive but unsure of other choices. Is staying outside US before completing 5year is an option? It may buy me few months. What will happen if they file PERM after 5 year has been completed in H1B status. What are my options? jairichi Posted August 24, 2015 Report Share Posted August 24, 2015 Attorney gave the right advice. An extension beyond 6 years on H1B is possible only if your PERM or I-140 is pending for approval for more than a year or with an approved I-140. Link to comment
