g_assprof Posted June 28, 2011 Report Share Posted June 28, 2011 Hi folks, I was wondering what happens in the situation that my PD (June 2007) becomes current in Aug 2011. Then suppose in September 2011, they push back availability to, say, July 2006 AND my pending 485 was not approved in the 1.5 months that it was current. Phew! Its confusing but I am asking what happens to people whose PD becomes current then un-current? Also what is the implication of this while filing for spouses 485 application once my PD is current? Attorney_17 Posted July 3, 2011 Report Share Posted July 3, 2011 The USCIS cannot accept an I-485 filing or approve an I-485 application unless the person's Priority Date is current. If the visa numbers retrogress, then the individual will need to wait until their Priority Date becomes current again in order for the USCIS to approve their case. Many individuals with I-485s filed during the summer of 2007 only recently received their green cards when their Priority Dates became current again. Link to comment
