vvh_net Posted August 13, 2015 Report Share Posted August 13, 2015 Recently I got my approval for my H1b petition (I-797B) but due to some reason USCIS has denied EOS (Extension of Stay). However my previous company's I-94 expires on October 2015. So Do I need to go for stamping anytime before October 2015 or do I need to leave the country immediately for Visa stamping purpose? Any suggestion on this would be a great help to arrange my travel plans. Thanks in advance!! Link to comment
jairichi Posted August 14, 2015 Report Share Posted August 14, 2015 If you would like to work after I94 expiry you need to go for visa stamping and enter US with a valid H1B visa and I797. Link to comment

G2_India Posted August 14, 2015 Report Share Posted August 14, 2015 One would accrue unlawful presence if USCIS found you in violation of status (as in most occasions), while denying the EOS even if you an i-94 (FAM is clear abt this). You should consult an experienced immigration attorney. If unlawful presence goes beyond 180 days you will attract three year bar to reenter U.S. Link to comment
