I have completed all my course work in 2013 May (2 Yrs back) but was stuck with my Research Project since then. I have worked on CPT and OPT for 1 and half year. This year my employer filed for my H1-B under Master's quota and got approved. But my problem is, I did not complete my master's yet. I still need to complete 1 credit in order to get my Master's degree which I hope I will be getting this december. So can you kindly let me know how does it going effect me in future? I still have my OPT Extension till next year October (2016). What should I do now? Should I cancel my H1 or do something else. Please advise me. Thank you,
JoeF Posted August 10, 2015 Report Posted August 10, 2015 So, that H1 was approved in error. And CPT is also a red flag. You need to discuss your situation with a good immigration lawyer.
psk04 Posted August 10, 2015 Author Report Posted August 10, 2015 Like, I worked on CPT for 8 months and OPT for 10 months and I have applied H1-B at the end of my OPT. My college people gave me a letter saying I have completed my course work 1 year back.
Attorney_15 Posted August 11, 2015 Report Posted August 11, 2015 If you completed all the requirements for the degree and included evidence to that effect you should be able to properly qualify for the Master's cap, but if that's not the case, then it could be a problem and USCIS could revoke the H1B approval at some unknown point in the future. Are you sure it was counted against the Master's cap?
