H1B transfer from non-profit to profit (applied for cap)

Hi,

 

I worked on OPT for the hospital (non-profit) from March 2011 - June 2013.

 

I have an approved H1-B from the non-profit organization from June 2013 - May 2016. In 2015 another profit company applied H1B (waiting for approval). If the H1B is approved through cap, can I stay with my non-profit org and not join the profit or will my current H1B be revoked from Oct 2015? Will this question require a legal consultation?
