J1 to H1B

Is a Change of status application for quota exempt H1B, permitted during J1 30 day grace period ?

 

My application reached on the 30th day and have received an RFE.

I believe the answer is yes. And, what is RFE about?

I dont think you can, the 30 day grace period is not a status so you cant change to something else from it.

 

What does your RFE say? Did you apply for your H1B while in the grace period?

 

BTW, did you also submit your J1 waiver letter from USCIS or DOS  with your H1B application?

As per my lawyer...as long as u submit your change of status application (for cap exempt h1) with a favorable DOS recommendatuon within the 30 days...you are good.

As a matter of fact...that's what I did. My h1 was filed on 7/29, and i never left US till date.

But could you work after filing h1b? Or do you have to wait for final approval??
