Hi All,

Need your valuable suggestion on below situation. Below is my history on H1B visa.

H1B expiry date: 7th Feb 2014

I94 expiry date : 7th Feb 2014

H1B extension denied after RFE on: 31st July 2014

Exited US on : 15th Aug 2014

Employer filed for Fresh H1B petition in Cap exempt quota on: 09th Sep 2014

H1B petition approved on: 16th Sep 2014

New i94 expiry date: 4th Jan 2016

Travelled to US back on : 11th Nov 2014 and in US since then..

Now i have found a new employer who is willing to sponsor my H1B and will also sponsor GC in future..

My question is -

1) What would be my out of status stay from my previous H1 extension? Would it be calculated from the date of denial or from the date when my i94 was expired?

2) Is there any risk of facing a 3 year ban if my out of status stay is calculated based on my i94 expiry date?

3) Would it affect my current H1B change of employer in anyway considering I have a history of denial but also have valid i94 and H1B work authorization at the time of change of employer?

Your help in above questions is deeply appreciated!

Thanks

Nik
