Travelling to India on H1

Hello,

 

I'm currently working as a contractor with a very reputed MNC in USA. My H1(filed by contracting firm) just got approved this June and is all set to begin in October. I'm planning to go to India in November for three weeks vacation as its been nearly three years since i went to India. These are my questions:

1) Will it be an issue if my contract firm doesn't pay that three weeks of vacation?  

2) Also, my visa consulate is Chennai. so when should i start looking to book for visa stamping dates as im planning to take vacation from second week of Nov till 30th Nov?

1. If you are outside US it does not matter whether you are paid or not.

2. Start looking regularly and once the slot opens book it.
