t_s Posted July 6, 2015 Report Posted July 6, 2015 Hi, While my parents were visiting us this year on a visitor visa, we have sponsored and applied for their permanent residency and they have received their A-number. Their I-94 expires at the end of July and their biometrics have not yet been scheduled. We would like them to stay here for a couple of more months to finish the application completely. Is I-539 the correct form to apply for their extension? Do I need to inform USCIS that a permanent residency application is in process? Thanks
JoeF Posted July 6, 2015 Report Posted July 6, 2015 As Permanent Residents, they have to live here. It seems that you only want them to visit once in a while... Pending I-485s keep them legal. A visitor extension would get denied anyway, due to immigration intent.

So if their I-485s are pending and they are legally present, then I will just skip their visitor extension. Thanks!
