I have following questions regarding our visas: 1. If I were to move on to my husband's L2 visa and get an EAD, can an employer process my green card? Is L1 or H1 mandatory for green card processing? 2. Can I apply L1 to L2 COS on my own or should a lawyer only do this on my behalf? Thanks,
jairichi Posted July 1, 2015 Report Posted July 1, 2015 1. Your employer can process GC anytime whether you in US or outside US. 2. You can file it. Fill form I539 and send it to USCIS with supporting documents and fee.
Attorney_21 Posted July 1, 2015 Report Posted July 1, 2015 KSSR318: 1) Your employer can file for a "green card" irregardless of what status you hold - L2, L1, H1B - it makes no difference. A green card case is always, technically, for future employment, so your current status is (for most purposes) irrelevant. 2) It's up to you - the process is straightforward, but there is a bit of a "learning curve" if you've never done this before. It might make sense to retain an attorney to avoid any delays in the process caused by inexperience.
