But in August 2011 i went to India and came back in Sep 2012 to USA and worked here on the remaining validity. When my first h1b was about to expire in Sep 2013 my employer applied for extension and got one year from Sep 2013 to Sep 2014 My question is because I was outside country for more than a year does it reset my H1B to 6 more years or how many years do i have left on my H1B ? For a H1B clock to reset a cap subject H1B petition has to be filed after you stayed outside US for a year. Since you are using the old H1B petition as cap exempt you have 6 years - time spent in US on H1B status. You will have 2 years 3 months. Link to comment
