Passport Expiry and H1b Stamp

A friend is planning to attend H1-B stamping in Canada, his petition is valid till October 2017 but passport is expiring in May 2016. Is it okay to travel with current passport and get the stamping done and then renew passport in USA? I know he will be getting I-94 till the passport expiry date but he will be going on vacation with new passport which will renew his I-94.

Hi Tony,

I've exactly the same question, my passport is expiring next year in June and just got my petition extended until 2018.

 

And my another question is how long would we get visa? i am thinking we will be issued until our passport expiry date which is next year 2016. Please correct me if i am wrong.

You will get a visa based on your H1B petition and it has nothing to do with passport expiry.

That's incorrect, visa on the passport will be issued as per your petition expiry date on I-797, however you will get I-94 valid till your passport expiry date. You can renew the passport after stamping and will have to travel with both the passport.

 

For I-94- Once you renew your passport you will have to cross the border and get a new I-94 based on your passport.

connected to this topic, do we need to have a passport which is valid for at least 6 months when we go for visa stamping? 

My passport is expiring on 13th Feb 2016 and Im planning to go for visa stamping in the beginning of August.
