silkroute Posted June 25, 2015 Report Share Posted June 25, 2015 I am on a H1B visa, currently almost finishing my fourth year. My greencard application submission date is Aug 2011 (EB2 category). My partner's J1 visa will expire next year. We are not married. Once his J1 expires he will have to return back to India for two years. I would like to know how does his visa situation change if we get married? Then can he work in the US? Will he still have to return back? We are trying to explore possibilities so that we can live together in the US. I have a secure job in a research related field which doesnot have much scope in India, atleast presently. I also have financial responsibilities towards my parents and siblings' education in India due to which I cannot quit my current job. Link to comment

Check with an attorney whether it is possible to move to H4 without getting a waiver. I know for sure it is not possible to move to H1B. Link to comment
