I94 expire with old H1 visa

Hi Gurus

 

I knew this is common question but my case is little different..

 

My current visa expire on 12th Sept 2015 & i am right now in process to extend(transfer) H1B

& it will take another 2-3 months..

 

My travel date to India on old visa : 8th-29th August and i am using old visa to get back in USA.

 

My doubt : The new I94 which i will receive will be valid till 12th Sept 2015 and by that time my H1 will be extended (transfer) to new employer..( the lawyer is same)

 

Do i need to worry about this I94 expiration? or I will get extended i94 automatically with H1 extension(transfer) ?

You have to plan this carefully. It is better if you have the extended petition in hand before traveling. If that is not possible, you should file the extension after returning.

 

The last issued I-94 determines your status. So if the last issued I-94 is up to September 12, your status will end on September 12.

I forgot to mention that I already started working with new employer as my petition is approved..

You need to show this new I797 at POE. Based on that you will get new I94
