subhajit4u Posted June 22, 2015 Report Posted June 22, 2015 Hi, I was in L1B with 5 years maxing out of Aug 15th 2014. My I94 was valid till Dec 8th, 2014. On July 24th, 2014 I applied for L2 through my husbands L1B and got approved L2 on November 24th, 2014. Since then I have applied L2 EAD and have it approved. Mine question is will I be counted out of status between Aug 15th, 2014 and Nov 24th, 2014 in future? I was not working in this period but as I had applied I94 conversion on an already valid I94 I didn't realize what to do at that point but understood it later.
jairichi Posted June 22, 2015 Report Posted June 22, 2015 USCIS cannot backdate its approval date. You were in valid status. Nothing to worry.

I would suggest to refer the date of L2 receipt notice as the end date of L1B and start date of L2. You need to back it up with experience letter, pay stubs, W2 ending by that date from ex-employer.
