mishti Posted June 16, 2015 Report Share Posted June 16, 2015 Hi, I have H1B visa expiring in 10 June 2016. My employer has just started my GC process and attorney is collecting information from me. Also I have taken two months vacation to outside of US till now. Can you please suggest me as what steps I should take to stay in US and don't have to leave US in this case as it looks like attorney will take 6-7 months time to file my perm. Link to comment
jairichi Posted June 17, 2015 Report Share Posted June 17, 2015 A PERM or I-140 waiting for approval for more than a year will get you 1 year extensions. Approved I-140 gets you 3 year extensions. If your PERM is filed by the end of the year you will not be eligible for any extension beyond 6 years. You would have to move to a dependent status or exit US. Link to comment
