EB2 I-140 approval did NOT recapture EB3 I-140 approval priority date...please help

I have an EB3 I-140 approval with a priority date of Jan 2006 from my previous employer which is now current per the May 2011 visa bulletin.

Last week my EB2 I-140 got approved but it did NOT recapture my old priority date. In this EB2 approval I have a priority date of Dec 2011 which is NOT current.

My I-1485 application is ready to be sent. Can I attach both my old I-140 and new I-140 approvals and send it to USCIS? Please advise.

Your lawyer should enclose a letter requesting the USCIS to port the old priority date to your new petition. Otherwise, your I-485 will be rejected as the PD of Dec 2010 is not current !!
