patriots15 Posted June 2, 2015 Report Posted June 2, 2015 Guys - I have a tricky situation here, please help me with your advise. I am currently working for Employer-A and now I have H1-B transfer already in process with USCIS to Employer-B. Also Employer-B just filed my PERM application with DOL. Also it just so happens that Employer-B is owned by Employer-A, we are doing this whole thing for my GC because of some other reasons. Now I already have a visa stamped on my passport for Employer-A till 2017. 1) - I am planning on travelling in August, by which time the PERM will be still be in process for sure, but not sure if the H1-B transfer will be approved, if say its still in progress, can I still travel with my current visa and I-797 from Employer-A in August?? 2) - Is it safe if I wait for the H1-B to be approved, and travel with current Visa and new I-797 ?? 3) I heard some where that it is not advisable to travel during PERM application in process, because the arrival !-94 changes, and this might trigger a AUDIT on the PERM, is that true?? Thanks much in advance for all the expert advise.
