CapExempt_nonprofit Posted May 29, 2015 Report Posted May 29, 2015 I want to know if Montana State Fund (MSF) in Helena, Montana is a cap-exempt organization? I mean can it file H1B round the year under cap-exempt status? Thanks in advance.

JoeF Posted May 29, 2015 Report Posted May 29, 2015 To copy my answer from another forum: Only universities, non-profit research organizations affiliated with universities, and government research organizations are cap-exempt.The organization you mention does not seem to be any of these. It is a state government organization, but not doing research. Therefore, an H1 from them would not be cap-exempt.

Hospitals that are affiliated with universities are cap-exempt, like university medical centers. That's covered by the rules I mentioned above. Not all non-profit hospitals are cap-exempt.
