krish2884 Posted May 27, 2015 Report Posted May 27, 2015 Hi, Recently I have changed the company due to acquisition (new employer bought the old employer). We were re-badged. My H1 max out date is Jan 2016 (including days outside US). My Old employer has filed my PERM in Nov 2014, which got approved in May 2015. Last month new employer filed for H1 transfer. Now they are about to start GC process. 1) Will I be eligible for seventh year extension from new employer (based on approved PERM from old employer)? 2) If not do I need to go out of country after Jan 2016 (Max out date) (Even if new employer applies my PERM) ? 3) What are other options for me to stay in this country with out leaving ?
jairichi Posted May 28, 2015 Report Posted May 28, 2015 1. Approved PERM gives you no extension. Only an approved I-140 does. Or a PERM or I-140 pending for more than a year. 2. Yes. 3. You can move to dependant status if your spouse is on a valid status in US.
