nthaccker Posted May 22, 2015 Report Posted May 22, 2015 So USCIS sent a publication out saying that it's temporarily suspending all premium processing for H1B extension of stay petitions ( http://www.uscis.gov/news/uscis-temporarily-suspends-premium-processing-extension-stay-h-1b-petitions ) MY case : I am currently on F1-B (had an 6 H1B before - so i don't fall under the CAP) & just got a job with join date of 1 month from now & hence wanted to file an H1B (COS from F1 to H1) Now can i still file H1B in premium ??? I need premium processing as in COS cases you can't work before H1B is completely approved And no company is going to wait for July 27th / 3 months for someone to join them Any suggestions what to do ??? jairichi Posted May 22, 2015 Report Posted May 22, 2015 Premium processing remains available for all other Form I-129 H-1B petitions, including petitions subject to the H-1B cap that are requesting a change of nonimmigrant status or consular notification.
Attorney_20 Posted May 23, 2015 Report Posted May 23, 2015 Have you explored all of your OPT and/or CPT work authorization options in F-1 status? You should definitely discuss your situation with an immigration attorney.
