saam4u81 Posted May 21, 2015 Report Posted May 21, 2015 How can I-94 be corrected if it is expired? my new petition (I-797) which was approved on June 2013 while I was in the states but working for another employer. My visa stamping expiration date was 03/12/15. I travelled to India last year with my old visa stamping and my new i-797 form. My POE was in JFK on 11/27/14. I presented my passport which had my old employer's visa stamping that was not expired then. But now my its expired. The officer didnt ask for my new petition which has i-94 expiration date of 05/15/2016. How can I-94 be corrected?
jairichi Posted May 21, 2015 Report Posted May 21, 2015 It was wrong from your part not to show immigration officer your new I797. Exit and enter US with a valid H1B visa and I797. Before that talk to a good attorney.
Attorney_20 Posted May 21, 2015 Report Posted May 21, 2015 You may want to discuss this issue with an immigration attorney as soon as possible, especially if the I-94 CBP gave you expired 2 months ago.
rammstein Posted May 23, 2015 Report Posted May 23, 2015 Although not common, but these are known issues, contact the deferred inspection site at JFK, they will correct it. The details for deferred inspection site are available on the online I94 page or you can just google.
