Iam added as a derivative on my husband's GC process.My husband is planning to travel on his valid H1B.Can I travel on AP? Iam added as a derivative and do have my own valid EAD/AP combo card apart from my husband's. Will there be an issue for me if he's not going to use his EAD/AP card at port of entry?Thanks
pingpong Posted September 26, 2015 Report Posted September 26, 2015 This is a toughie, All responses are un related 1) If you are waiting for your AP, then my advice is to postpone your travel until it is approved. 2) If your husband is going to enter on H1 then you can re enter on H4. If he wishes to exercise his AP then your H4 becomes invalid. 3) An EAD/AP only allows the person named to use the privileges. Derivatives need their own EAD/AP.
