H4 -EAD and H1 extension

Hi ,

 

I am currently on H4 .Can  I apply for H4-EAD On May 26  and also parallely apply for H1 extension(premiuim processing)  in July 2015 as I will be eligible for 1 year extension on AC21 . I want to be on either h4 ead or H1 whichever gets approved first .I want to apply for H4 EAD as well just so I can have an option in case H1 extension does not go through . Can we apply for both at the same time.

If you are on H4 now then there is no way you can apply for H1B extension. An employer can only file a cap exempt H1B petition.

Yes , I am .

 

I was on H1 before and will be eligible for h1 extension on ac21 in Julu .If I do premium processing , it takes 2 weeks for the decision but since H4 ead takes 90 days to process , I do not want to waste that time in the interim.

But H4 EAD has no restrictions compared to H1.
