abysmal Posted April 27, 2015 Report Posted April 27, 2015 Hi, I had applied COS from H1B to H4 in Nov 2014 at VSC which is still under processing. Am eligible to apply for H4 EAD once my H4 visa comes through by May 26 2015. However, I realized that my passport is only valid until Oct 17 2015. Will this cause USCIS to provide EAD only until my passport valid period? Or will I get EAD until my spouse's H1B expiry? Please advise. Also, am unable to renew my passport currently, since I need to prove my status (which is pending with USCIS now) or submit 2 GC holders information which I do not have. Will it be OK to apply for EAD with this passport or should I wait to renew first? Many Thanks!

Is it OK to apply for EAD using a passport that is expiring in few months? If the processing for EAD takes more than the typical SLA of 3 months, pls note that my passport will have expired while EAD is going on. 2. Will EAD end date be impacted by Passport validity? 3. Will EAD end date be given until the H4 / Spouse's H1B expiry dates?
jairichi Posted May 7, 2015 Report Posted May 7, 2015 Your passport expiry date has nothing to do with EAD. As long as your I94 expiry date is fine your EAD will be approved.
