chintudutta
Hi, I am currently in India and I have a approved H1B petition based on my I140 approval from Company A. Now I want to join Company B but I want to know whether the H1B can be transferred based on the approved petition. I don't have a stamped visa yet from company A, just have the approved petition. Thanks, Chintu Link to comment
jairichi
Yes, employer B can file a cap exempt H1B petition as long as I-140 is valid at the time USCIS processes that petition. Link to comment
chintudutta
Thanks! just 1 more q.. can the H1B transfer petition be initiated by company B before I join them.. also can stamping be done as soon as the petition be approved.. just want to make sure that I have a stamped visa before I join a new company since this is solely for a US opportunity...
