Non-compete agreement with employer

Hi,

I had signed a non-compete agreement with my employer while coming to US.

Now my client has offered me a full-time position, after going through the legal contract between my employer and them.

He has asked me to apply for new job posting.

 

Client will also take this up with my employer.

 

Should my employer resist, can they revoke my H1 ?

Should I go ahead with the application and get my H1 transferred ?

 

I want to know, what will be the implications if I join my client directly ?

Is the non-compete agreement valid in US.

 

Please help, I have been forced to a new technology and location by my employer since last 2 weeks.

But I like the work I am doing and want to continue with my client.

Yes, employer can take legal action if you have signed non compete agreement.

Yes, the agreement is valid in US. First let the client clear it up with employer and based on that think about moving to client.
