I am planning my India trip after nearly 8 years. I have my I-140 approved and waiting for Priorirty date (EB2).

 

I had a family dispute with my wife which unfortunately led to an arrest record on 2013 sept in CT.

misdemeanor charge and felony charge ( presence of child in the house)

 

The case was dissmissed in the court. No convictions ( it was handled by family court as they said its first time offense)

 

I was not found guilty on any of the charges.

 

I later moved out of state with my family for my job.

 

questions

1) What to expect in Visa interview ( i have the certified court disposition document)

    Anything else to be concerned? Any chance of visa not getting approved ?

 

2) Any other document should i take ( like letter from Attorney who helped in the case)

 

3) Port of Entry issues ( Anything to be concerned)

 

 

Please let me know if anything i have missed to cover. Please help me as i have lot of tensions due to this issue

1. Court certified disposition documents that prove you were not convicted.

2. Certified Copy of the register of actions.

3. Copy of charge sheet.

4. Letter from attorney stating your case was closed

 

Carry the above four documents. If the VO asks about the incident (which they most likely will) - tell them what happened and that the case was dismissed. 

 

You should be fine for the most part. 

 

Worst case, they may issue a 221(g) to check if you have had any other issues in the past.

This may delay your stamping process a bit.

I need help in one other area. I am working for financial client for past one and half year. We do not get client letter from Financial clients. I can get an email saying its not their policy to give letters.

 

In my case, will it be an additional scrutiny for my Visa stamping.

 

I have a my company--->service provider--> End client ( where i work)

 

Please let me know what documents to be carried as alternate for Client Letter.

i have a question related to H1-B amendment. I have the petition from old client, but due to region was under same Metro.

I didnt file H1-amendment for new client.

or i should file an amendment with new client for the Visa stamping ?
