Shresta
My In laws visited us in July08 in B1/B2 Visa and in Nov08 we applied for their extension but unfortunately their extension was denied in march and USCIS gave a month for them to return back and they returned by end of March. We noticed from some of the forums that if their extension was denied their B1/B2 is void. we are planning to bring them this summer. Is there a way to find out whether their B1/B2 is still valid. Thier stamping expires in March 2018. What is the best possible option? Do they have to go for restamping? or use the same visa if they go for restamping what is the possibility of getting visa again Attorneys please answer Link to comment
jairichi
Yes, by law their visa is void now. They need to apply for a visitor visa again. Chances are slim as they had overstayed. Let them give a try. Link to comment
ashuneel
YOU should not be forcing people to apply for visa extensions for your personal gains. Did they genuinely want to stay longer than the validity of I-94. If so, they can explain that at the next interview. I think you can travel the entire length US multiple times in 6 months so they need to have strong reason to apply for extension and future visas. Link to comment
