vj2617 Posted April 16, 2011 Report Posted April 16, 2011 Here is my case.: -- My Wife Came on H4 visa in 2008 (valid till May 2010). -- Applied for H1B after coming to US and got the approved petition with I-94 eligible to work from Oct. 2008. -- She did not work any where (didnt have any pay stubs, W2 etc employer didnt pay her.) -- She went to India in April 2009 and came back on previously stamped H4 visa in May 2009. -- Her H4 got expired May 2010 filed for H4 extension got the approved petition (valid till Sep 2013) -- She went to India April 2011 Now I am filling the form DS-160 for her H4 visa stamping Now my questions are - 1. Have ever been issued a US visa? Yes or NO If I select "Yes" then the below questions a. Date Last visa was issued : what I have to answer for this (Is it H4 visa stamping date or H1 petitions approved date) b. Are you applying for the same type of Visa? Yes or No What I need to select? c. Are you applying in the same country where the visa above is issued and is this country is your principal country of residence? Yes or No what I need to select? 2. Were you previously employed? Yes or No What I have to choose "Yes" or "No". If I select "Yes" below are the questions. Employer/Employment Information: Employer Name : Employer Street Address (Line 1) : Employer Street Address (Line 2) : City : State/Province : Postal Zone/ZIP Code : Country : Supervisor's Surname : Supervisor's Given Names : Employment Date From : Employment Date To : What Information I can fill in above because she did not work even a single day does not have any pay stubs, W2 etc and also the supervisor information and begin and end dates. If I select "No what will be the problem? If anyone answers to above questions will be a great help. Thanks, VJ

sg2011 Posted April 20, 2011 Report Posted April 20, 2011 I would suggest you answer all the questions correctly and truthfully. All of them are self explanatory. example- 1. H1 and/or H4 are considered US visa 1a. Last visa was H4 or H1? whichever is the most recent is the last visa issued 1b. If applying for H4 stamping and last visa was also H4 then Yes 1c. If stamping was done in India then yes 2. If employed then Yes (i.e. was on H1) Also, avoid New Delhi for your interview. You can take Kolkata or Chennai since ND consulate is issuing a lot of 221g.
